TOWN OF AMENIA
NOTICE OF ADOPTION OF RESOLUTION
SUBJECT TO PERMISSIVE REFERENDUM
Notice is hereby given that the Town Board of the Town of Amenia, Dutchess County, New York, at a regular meeting thereof, held on September 3, 2026, duly adopted the following resolution, subject to permissive referendum:

RE: AUTHORIZING PURCHASE OF PLOW TRUCK FOR HIGHWAY DEPARTMENT SUBJECT TO PERMISSIVE REFERENDUM
WHEREAS, the Town of Amenia previously established a Highway Department Equipment and Machinery Reserve Fund for the purchase of capital equipment and machinery for the Town of Amenia Highway Department, such as pickup trucks, loaders, backhoes, sanders, dump trucks, and related equipment; and
WHEREAS, the Town Highway Superintendent has recommended the purchase of a new plow truck for the Highway Department to add to their aging fleet to ensure plowing capacity and capability in the future; and
WHEREAS, pursuant to General Municipal Law § 103(16), municipalities are authorized to purchase equipment and contract for services related to installation thereof through the use of a contract let by the United States of America or any agency thereof, any state or any other county of political subdivision or district therein, if such contract was let in a manner that constitutes competitive bidding consistent with state law and made available for use by other governmental entities; and
WHEREAS, the Town of Amenia has been provided with a proposal from Zwack Inc. through Onondaga Bid # 0010914 for the purchase of the plow truck body in the amount of $161,995.00; and
WHEREAS, the Town of Amenia has been provided with a proposal from Allegiance Trucks Hudson Valley at Upper Hudson Valley, LLC through ON/GOV Bid # 106-19 for the purchase of the plow truck cab and chassis in the amount of $183,944.80; and
WHEREAS, the total purchase price for the plow truck is $345,939.80; and
WHEREAS, the funds are available in the Highway Department Equipment and Machinery Reserve Fund; and
WHEREAS, the Town Board of the Town of Amenia wishes to award the contract to Zwack Inc. through Onondaga Bid # 0010914 for the purchase of the plow truck body in the amount of $161,995.00, in accordance with the annexed proposal; and
WHEREAS, the Town Board of the Town of Amenia wishes to award the contract to Allegiance Trucks Hudson Valley at Upper Hudson Valley, LLC through ON/GOV Bid# 106-19 for the purchase of the plow truck cab and chassis in the amount of $183,944.80, in accordance with the annexed proposal; and
WHEREAS, the Town Board has reviewed each of the proposed bids and verified that the contracts have been properly let in a manner that constitutes competitive bidding consistent with New York State Law and made available for use by other governmental agencies.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations set forth above are incorporated in this Resolution as if fully set forth and adopted herein.
2. The Town Board of the Town of Amenia hereby awards the contract for the purchase of the plow truck body to Zwack Inc. through Onondaga Bid # 0010914 in the amount of $161,995.00, in accordance with the annexed proposal.
3. The Town Board of the Town of Amenia hereby awards the contract for the purchase of the plow truck cab and chassis to Allegiance Trucks Hudson Valley at Upper Hudson Valley, LLC through ON/GOV Bid# 106-19 in the amount of $183,944.80, in accordance with the annexed proposal.
4. The Town Supervisor is authorized and directed to execute any documentation necessary to effectuate this Resolution.
5. The purchase of the plow truck body, cab and chassis shall be made from the Highway Department Equipment and Machinery Reserve Fund and is subject to a permissive referendum in accordance with New York State Town Law Section 6-C of the General Municipal Law.
